Americans in the 21st century cite the relatively recent Watergate Scandal, and to a lesser degree the Enron Oil Scandal, as prime examples of modern governmental corruption. It is a widely held perception that these incidents, particularly the one bringing about the first resignation of an American president, caused the public to lose trust in federal institutions and political figures. However, the prototype for the breakdown of governmental fidelity lies in the early 20th century, a time in which the recent territories of the United States struggled to evolve from a lawless, Wild West culture. The federal government viewed its western resources as both unlimited and outside the grasp of the government. The leading oil barons, born and raised in the 19th century, were accustomed to federally-blessed land-grabs and easily obtained mining and lumber interests, often doled out to the social and financial elite under the guise of exploration. Federal interference was minimal in contrast to later decades, and the government itself was eager to conquer the West through large-tract farming, river management, mineral and timber development, not to mention the procurement of oil for a growing society as coal gave way to new types of fuel. The early 20th century was a time of sudden growth for the young American automobile industry, and of a military beginning to extend its reach around the world. In what would become largely a jurisdictional dispute over Western natural resources, the unbridled oil industry of the new century collided with the United States military and the Department of the Interior, set against the dominance of a corruption-riddled presidential administration. For the first time in American history, in a contest between entrepreneurism and government management, a high-ranking cabinet official was convicted of corruption and sent to prison in the aftermath, along with his co-conspirators. Modernizing the Role of the International Court of Justice (eBook, PDF)
This book discusses the future role of the International Court of Justice (ICJ) in a world facing survival challenges. It discusses threats such as climate change, environmental degradation and pandemics, and argues that in the future the ICJ will need to carry out judicial, security and protection functions as it is the only organ of the United Nations (UN) that can discharge such functions in view of its independence and expertise. The author proposes that the ICJ can apply a hitherto unused jurisdictional provision in Article 36 of its statute that allows it to deal with "All Matters Specially Provided for in the UN Charter" and presents three examples of issues that would require the urgent attention of the ICJ: vaccine equity in a global pandemic, climate disaster, and mass movements of people across frontiers due to climate change and environmental degradation. Bertrand Ramcharan (Guyana) is a Barrister-at-Law of Lincoln's Inn with a Doctorate in international law from the London School of Economics (LSE) and the Diploma in International Law of the Hague Academy of International Law. He was LSE International Law Scholar and has been Commissioner of the International Commission of Jurists and a Member of the Permanent Court of Arbitration. He has also been Director of the Research Centre of the Hague Academy of International Law (The Right to Life), Professor at the Geneva Graduate Institute, and Chancellor of the University of Guyana. He is a former Chief speech-writer of the UN Secretary-General, and has performed the functions of UN High Commissioner for Human Rights. This book traces, assesses and compares the history of conscientious objection - in the cultural context of six common law nations - from refusal of military service and a range of similar moral dilemmas, to objecting to abortion, to the current social polarisation surrounding vaccination hesitancy in the COVID-19 pandemic.It considers the impact of this form of dissent in relation to social movements like Black Lives Matter, social activists such as Gandhi, and whistle blowers like Daniel Ellsberg. It reflects on the relationships between the sacred and the secular, the state and the citizen, in order to better understand the responsibilities of citizenship in our increasingly secular societies. It analyses what defines the conscientiousness of an objection from both legal and ethical standpoints. It examines what constitutes a matter of conscience, why this should justify exemption from civic duties and why this form of dissent has such a time-honoured status. It explores the increased reliance on "grounds of religion, belief or conscience" as providing justification for excusing some citizens from complying with certain responsibilities - mandated by equality and non-discrimination legislation - that are binding for all others.By conducting a comparative evaluation of national law and judicial rulings on a fixed agenda of issues, this book identifies key jurisdictional differences concerning conscientious objection. In so doing, it highlights the importance of cultural context and constructs a jurisdiction-specific overview of legislation, policies and case law. By tracking policy developments and highlighting crucial judicial rulings - particularly in the US - it provides insights into the probable future direction of developments in national law relating to conscientious objection.Lastly, the book draws attention to some of the potential consequences of manifesting dissent by opting out of performing public services - e.g. the possible local breakdown of specific service availability (e.g. abortion, officiating at same-sex marriages, and immunisation); prompting population movements as established democratic civil rights are locally negated (reproductive rights, LGBT rights, right to health protection); fragmenting society into a geographic patchwork of regions in which some citizens are branded as conservative/reactionary and others as progressive; and fuelling the culture wars - with profound implications for a coherent democratic society.- Shop: buecher
