Doch während John Locke den Sinn für die Errichtung einer Regierung in dem dadurch ermöglichtem Schutz von Eigentum sieht, scheint Rothbard jede Form von Herrschaft abzulehnen. Dass sich Personen oder Organisationen nicht über den freien Markt finanzieren, ist für Rothbard ein unmoralischer Vorgang, es handele sich um einen Verstoß gegen das Naturrecht.Es gebe nur zwei Formen menschlicher Kooperation, eine die auf Raub von Eigentum durch Gewalt beruhe und die des friedlichen Tausches. "Just as the two basic [...] interrelations between men are peaceful cooperation or coercive exploitation, production or predation" (Rothbard 2009a: 53-55).Die Institution des friedlichen Tausches, welche mit dem Naturrecht in Einklang stehe, sei der freie Markt und die Institution des Raubes sei der Staat. In dieser Arbeit rekonstruiere ich Rothbards Delegitimationstheorie des Staates.
